This Indenture Made this Second (2nd) day of December one thousand eight hundred and seventy Six by and between the Atchison, Topeka And Santa Fe Railroad Company, a Corporation doing business under the laws of the State of Kansas, and Thomas Nickerson, Emmons Raymond, and Georqe B. Wilber, of the State of Massachusetts, as Trustees, as hereinafter stated, parties of the first part, and Catherine Michaelis of Wabaunsee County State of Kansas party of the second part: Witnesseth, That the said Atchison, Topeka and Santa Fe Railroad Company, for and in consideration of the sum of Four Hundred (400) Dollars, to it duly paid by the said Catherine Michaelis the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents doth grant, bargain, sell and convey unto the said Catherine Michaelis her heirs successors and assigns forever, all that tract, price and parcel of land situate in the County of Wabaunsee in the State of Kansas, to wit: The East Half (1/2) of the North West quarter (1/4) of Section No. Twenty One (21) in Township No. Eleven (11) South of Range No. Eleven (11) East of the Sixth Principal Meridian containing Eighty (80) acres, more or less according to the United States Survey. To Have and to Hold, the said premises with the appurtenances, unto the said Catherine Michaelis his heir successors. and assigns forever. And the said Atchison, Topeka and Santa Fe Railroad Company doth hereby covenant with the said Catherine Michaelis her heirs successors and assigns, that the possession and title to the said premises, with the appurtenauces to the said Catherine Michaelis her heir successors and assigns, will forever warrant and defend. And whereas, heretofore, to wit: on the first day of November, A.D. 869, the said Atchison, Topeka and Santa Fe Railroad Company executed and delivered to Henry Keyes, of Newbury, Vermont, Thos. Sherlock, of Cincinnati, Ohio, and Henry Blood, of New York, as Trustees, its certain Indenture 584 or Deed of Trust on the above described premises, together with other lands and tenements, for the purposees therein slated: and where as, the said Thomas Nickerson, Emmons Raymond, and Geo. B. Wilbur are now the Trustees under said indehture, (being the duly and lawfully appointed successors of the said Keyes, Sherlock, and Blood, as such Trustees aforesaid,) and whereas the Atchison, Topeka and Santa Fe Railroad Company has this day paid to them as the Trustees under said Indenture, the sum of Four Hundred (400) Dollars, being the proceeds of the sale of said lands and tenements hereby conveyed, the receipt whereof is hereby acknowledged by said Trustees: Now, therefore, we, the said Thomas Nickenon, Emmons Raymond, and George B. Wilbur, as Trustees, as aforesaid, in consideration of said sum of Four Hundred (400) Dollars, to us in hand paid, as aforesaid, have and do hereby release and forever discharge the said lands herinbefore described from any and all incumbrances or liens whatever erected thereon by the Indenture or Deed of Trust aforesaid. In Witness Whereof, The said Atchison, Topeka and Santa Fe Railroad Company has caused this Deed to be signed by its Vice Presidentm and attested by its Secretary, and sealed with the common seal of said Corporation. And the said Thomas Nickerson, Emmons Raymond, and George B. Wilbur, Trustees as aforesaid, have each hereunto set their hands and seals, this Eighteenth day of December A.D. 1876. | |||
